The Summons is the document that hails the other party into court. It states as required in O.C.G.A. [Official Code of Georgia Annotated] § 9-11-101, "To the above-named defendant: You are hereby summoned and required to file with the clerk of said court and serve upon ______, plaintiff's attorney [this could be Plaintiff's name if there is no Plaintiff's attorney], whose address is ________ [this could be Plaintiff's address if there is no Plaintiff's attorney], an answer to the complaint which is herewith served upon you, within 30 days after service of this summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint." Service of the Summons and related documents should be by sheriff or as otherwise provided by law. Two forms are provided here. One is specific to Gwinnett County, Georgia, and the other is an open form based on the statute that can be filled with any county's name and that county's clerk.
